Summary in plain language
- You must be at least 16 years old.
- The game is free and the account is optional.
- The game is for your personal use; you can't copy it or cheat to gain an advantage.
- Nothing in these terms affects your statutory rights as a consumer.
1. Who we are and accepting these terms
Can in One is a video game by Manuel Villanueva (“we”). Full details are in the legal notice. By installing the game, creating an account or playing, you accept these terms. If you do not agree, do not use the game.
2. Minimum age
You must be at least 16 years old. If you are under 18, you also need the authorisation of your parents or guardians where the law requires it.
3. Your account
You can play without an account: your progress stays on your phone and, if you uninstall the game or lose the device, it may not be recoverable.
If you sign in with Google or Apple, your progress is copied to the cloud so you can carry on from another phone. If you sign in with Apple, you can only recover it on an iPhone or iPad. The account is personal and you are responsible for what you do with it. You can delete it whenever you like.
4. Licence to use the game
We give you a personal, non-exclusive, non-transferable and revocable licence to install and use Can in One for non-commercial purposes, in accordance with these terms and the conditions of the App Store or Google Play. The game is not sold: it is licensed. You may not copy, distribute, modify or decompile it, except where the law allows you to do so regardless of these terms.
5. Ads and purchases
The game is free and, for now, has no ads or purchases. If we add them, these conditions will apply:
- Ads: only in natural breaks, never in the middle of a stroke and not after every miss.
- Remove ads: a single optional payment. Payment is taken by Apple or Google, and you will see the final price before paying. There is no virtual currency and no purchases have random contents.
- Withdrawal: as a consumer in the EU, you have 14 days to withdraw from your purchase. As this is digital content supplied immediately, you lose that right only if you expressly consent to immediate supply and acknowledge that you will lose it. Refunds are handled by the store where you made the purchase.
6. Fair play
You may not use cheats or third-party programs, or exploit bugs, to alter your progress, and you may not attack or overload our servers.
7. Intellectual property
The code, art, music, sounds, text, design and brand of Can in One belong to us or our licensors. Copying, distributing or creating derivative works from them is not allowed, except as these terms or the law permit.
8. Availability and changes to the service
The game receives updates that may change levels and features, and some may be required for you to keep playing. Access to the account and the cloud copy may be temporarily interrupted for maintenance or for reasons beyond our control.
If a change has more than a minor negative impact on something you have paid for, we will tell you first and you will be able to terminate the contract and receive the corresponding refund. If we close the service, we will announce this at least 30 days in advance.
9. Suspension and termination
We may suspend or close an account used in breach of these terms. We will tell you what happened and why, and you can appeal by writing to manuel.villanueva.dev@gmail.com.
10. Legal guarantee and liability
As a consumer, you have the legal guarantee of conformity for digital content and services (in the EU, Directive (EU) 2019/770; in Spain, Articles 114 et seq. of the General Law for the Defence of Consumers and Users). If something does not work as it should, write to us.
We are liable without limitation for damage caused intentionally or through gross negligence, for death, personal injury or harm to health, and in other cases where the law does not allow liability to be limited. For slight negligence, we are liable only if we breach an essential obligation of the contract, and only up to the amount of typical, foreseeable damage. If an error on our part causes you to lose cloud progress, we will restore it wherever possible.
Nothing in these terms limits the rights you have under the mandatory consumer law of your country.
11. Governing law and jurisdiction
These terms are governed by Spanish law. If you are acting as a consumer resident in the European Union, you retain the protection of the mandatory rules of your country of residence and can bring proceedings in the courts of your place of residence.
12. Changes to these terms
We may update these terms because of changes in the game, in the law or in how we provide the service. If the change is substantial, we will announce it reasonably in advance, explain what changes and ask you to accept it. If you do not agree, you can stop playing and delete your account at no cost. Minor changes, such as typo corrections, apply as soon as they are published.
13. Contact and language
